The following policies are applicable to all pilgrimages registered through Carol Osterhus and Clear to There, LLC. Participants are required accept and sign these terms in order to register for our events.

1) Jurisdiction

Any dispute arising in connection with the contract shall be determined in accordance with the laws of the State of Minnesota.

2) Accepting terms and conditions

Making any payments (cash, credit card, or check) towards the pilgrimage constitutes your unconditional acceptance of all the terms and conditions stated in this document.

3) Individual Cancellation Fees and Refunds

Notice of cancellation must be signed, dated, and received in writing via e-mail to CJOsterhus@gmail.com.   You will receive a refund for your payment for services not received by you, minus applicable cancellation fees, according to the following schedule:

  • For the Camino Frances, “Walking Easy,” before June 1, 2023, the cancellation fee is $450.00 (this fee covers the amount of the non-refundable, non-transferable deposit, plus administrative expenses);
    After July 16, 2023, there are no refunds.

4) Pilgrimage cancellation

For cancellation beyond our control without prejudice to the participant’s statutory rights, Clear to There, LLC/Carol Osterhus reserves the right to alter, change, curtail, or cancel the pilgrimage. Sometimes it is necessary to cancel a pilgrimage due to insufficient booking (four months prior to departure dates) or some other extraordinary event such, resurgence of COVID-19 or variant or illness or death in the family.

5) Health

It shall be the participant’s responsibility to complete and submit the required confidential medical information, stating any medical, physical, or mental conditions, which may interfere with participation in the pilgrimage.   Clear to There, LLC reserves the right to refuse participation in the pilgrimage of any person who fails to disclose known medical, physical, or mental conditions.  In such instance, Clear to There, LLC will be held harmless for any action taken to refuse participation in the pilgrimage, including forfeiture of payments and deposits.  By signing this document, the participant acknowledges that the confidential medical information is accurate.

6) Declaration of Fitness

The participant declares, upon completion of this registration form, that he/she is physically fit for this pilgrimage. The amount of walking varies from day to day and does include rough and uneven terrain and uphill grades, coastal pathways, and roads.

7) Insurance

Clear to There, LLC recommends that the participant be covered with the appropriate travel insurance. Coverage should be arranged by the participant and fully cover for all health, luggage, and travel arrangements.  By accepting these terms, the participant acknowledges that obtaining appropriate coverage is the participant’s responsibility.

8) Making Changes to the Itinerary

Occasionally, it is necessary to make changes from the itineraries advertised. These changes may be slight alterations to the order of the daily schedule or changes to the accommodations. Clear to There, LLC/Carol Osterhus will inform participants and ensure that all the alternatives used are similar to those advertised.

9) COVID-19 Policy & Protocol

I accept and understand that, due to the global pandemic involving COVID-19, by attending this pilgrimage I am placing myself at serious risk of contracting COVID-19, which may lead to serious injury and death. I accept and certify that I do not have any COVID-19-related symptoms, and if I do during the pilgrimage, I will immediately advise Carol Osterhus to make suitable arrangements to avoid contact with others and to prevent the spread of COVID-19. I UNDERSTAND AND AGREE, ON BEHALF OF MYSELF, AND ANY AND ALL SPOUSES, HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN THAT MY ACCEPTING THESE TERMS AND SUBMITTING REGISTRATION CONSTITUTES THE FOLLOWING RELEASE:

RELEASE: YOU HEREBY EXPRESSLY ASSUME ALL OF THE RISKS AND DANGERS COVERED IN THE PARAGRAPHS ABOVE, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.

Liability Disclaimer. Clear to There, LLC/Carol Osterhus hereby expressly disclaims any liability for any personal injury, property damage, loss of baggage, accident, delay or irregularity, any claim for special or consequential damages, or any other loss which may be occasioned by the acts and/or omissions, including COVID-19 related loss, whether negligent, intentional, wrongful or otherwise, of any air carrier, hotel/motel or other lodging provider, railroad operator, bus operator, public transportation, sea carrier, local sightseeing company, pilgrimage operator, pilgrimage leader, any employees thereof, or any other entity or individual not under the direct supervision and control of Clear to There, LLC/Carol Osterhus when engaged in conveying the passenger or in carrying out the arrangements of the pilgrimage, or otherwise in connection therewith.

BY ACCEPTING THESE TERMS WITH REGISTRATION, I SIGN THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT. I ACKNOWLEDGE THAT I HAVE READ ALL PAGES AND FULLY, UNDERSTAND ITS TERMS, INCLUDING BEING ADVISED I SHOULD OBTAIN INDEPENDENT LEGAL ADVICE, AND HAVE ACCEPTED ALL TERMS FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME.
